{"data":{"id":"us-ky/krs-383.555","jurisdiction":"us-ky","citation":"KRS 383.555","heading":"Unconscionability.","body":"(1) If the court, as a matter of law, finds:\n(a) A rental agreement or any provision thereof was unconscionable when made,\nthe court may refuse to enforce the agreement, enforce the remainder of the\nagreement without the unconscionable provision, or limit the application of\nany unconscionable provision to avoid an unconscionable result; or\n(b) A settlement in which a party waives or agrees to forego a claim or right under\nKRS 383.505 to 383.715 or under a rental agreement was unconscionable\nwhen made, the court may refuse to enforce the settlement, enfor ce the\nremainder of the settlement without the unconscionable provision, or limit the\napplication of any unconscionable provision to avoid an unconscionable\nresult.\n(2) If unconscionability is put into issue by a party or by the court upon its own motion,\nthe parties shall be afforded a reasonable opportunity to present evidence as to the\nsetting, purpose, and effect of the rental agreement or settlement to aid the court in\nmaking the determination.","path":["KRS Chapter 383"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=35728","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:14Z","sha256":"eb93255f6954be13e47855f29b81c8191a1f85324b669afb5930c5707bb88423","source_id":"us-ky","stale":false,"prev":"us-ky/krs-383.550","next":"us-ky/krs-383.560"},"notice":"GroundRules: Original legal text.
