{"data":{"id":"us-ky/krs-383.625","jurisdiction":"us-ky","citation":"KRS 383.625","heading":"Noncompliance by landlord.","body":"(1) Except as provided in KRS 383.505 to 383.715, if there is a material\nnoncompliance by the landlord with the rental agreement or a noncompliance with\nKRS 383.595 materially affecting health and safety, the tenant may deliver a written\nnotice to the landlord  specifying the acts and omissions constituting the breach and\nthat the rental agreement will terminate upon a date not less than thirty (30) days\nafter receipt of the notice if the breach is not remedied in fourteen (14) days, and the\nrental agreement shall terminate as provided in the notice subject to the following:\n(a) If the breach is remediable by repairs, the payment of damages or otherwise\nand the landlord adequately remedies the breach before the date specified in\nthe notice, the rental agreement shall not terminate by reason of the breach.\n(b) If substantially the same act or omission which constituted a prior\nnoncompliance covered by subsection (1) of which notice was given recurs\nwithin six (6) months, the tenant may terminate the rental agreem ent upon at\nleast fourteen (14) days' written notice specifying the breach and the date of\ntermination of the rental agreement.\n(c) The tenant may not terminate for a condition caused by the deliberate or\nnegligent act or omission of the tenant, a member of his family, or other\nperson on the premises with his consent.\n(2) Except as provided in KRS 383.505 to 383.715, the tenant may recover damages\nand obtain injunctive relief for any noncompliance by the landlord with the rental\nagreement of KRS 383.595.\n(3) The remedy provided in subsection (2) is in addition to any right of the tenant\narising under subsection (1) of this section.\n(4) If the rental agreement is terminated, the landlord shall return all prepaid rent.","path":["KRS Chapter 383"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=35742","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:14Z","sha256":"1a8d81ee0184a220cccd7e2c22fcd1bda5e4ff4333af9762edebb797d0b0c767","source_id":"us-ky","stale":false,"prev":"us-ky/krs-383.620","next":"us-ky/krs-383.630"},"notice":"GroundRules: Original legal text.
