{"data":{"id":"us-ky/krs-383.630","jurisdiction":"us-ky","citation":"KRS 383.630","heading":"Landlord's failure to deliver possession.","body":"(1) If the landlord fails to deliver possession of the dwelling unit to the tenant as\nprovided in KRS 383.590, rent abates until possession is delivered and the tenant\nmay:\n(a) Terminate the rental agreement upon at least five (5) days' written notice to\nthe landlord and upon termination the landlord shall return all prepaid rent and\ndamage fee; or\n(b) Demand performance of the rental agreement by the landlord and, if the tenant\nelects, maintain an action for possession of the dwelling unit against the\nlandlord or any person wrongfully in possession and recover the damages\nsustained by him.\n(2) If a person's failure to deliver possession is willful and not in good faith, an\naggrieved person may recover from that person an amount not more than three (3)\nmonths' periodic rent or threefold the actual damages sustained, whichever is\ngreater, and reasonable attorney's fees.","path":["KRS Chapter 383"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=35743","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:14Z","sha256":"0c17e4695e108b64ffefa889a57aa0b6a27affd4cc791749ccdc160ec00f1408","source_id":"us-ky","stale":false,"prev":"us-ky/krs-383.625","next":"us-ky/krs-383.635"},"notice":"GroundRules: Original legal text.
