{"data":{"id":"us-ky/krs-383.635","jurisdiction":"us-ky","citation":"KRS 383.635","heading":"Remedies for noncompliance that affects health and safety.","body":"(1) If the landlord willfully and materially fails to comply with the rental agreement or\nfails to comply with KRS 383.595 and such noncompliance materially affects health\nand safety and the reasonable cost of compliance is less than one hundred dollars\n($100), or an amount equal to one -half (1/2) of the monthly rent, whichever amount\nis greater, the tenant may notify the landlord of his intention to correct the condition\nat the landlord's expense. If the landlord willfully fails to comply within fourteen\n(14) days after being notified by the tenant in writing or as promptly as conditions\nrequire in case of emergency, the tenant may cause the work to be done in a\nworkmanlike manner and, after submitting to the landlord an itemized statement for\nthe work actually  done and for which the tenant has paid in full, deduct from his\nrent the actual and reasonable cost or the fair and reasonable value of the work, not\nexceeding the amount specified in this subsection.\n(2) A tenant may not repair at the landlord's expense if the condition was caused by the\ndeliberate or negligent act or omission of the tenant, a member of his family, or\nother person on the premises with his consent.","path":["KRS Chapter 383"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=35744","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:14Z","sha256":"05ba404c8d25ae986203171544bc3b711ebcdee9c115f213738f573f306c0e3e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-383.630","next":"us-ky/krs-383.640"},"notice":"GroundRules: Original legal text.
