{"data":{"id":"us-ky/krs-384.080","jurisdiction":"us-ky","citation":"KRS 384.080","heading":"Performance of notarial acts by commissioned officers of armed forces.","body":"(1) In addition to the acknowledgment of instruments and the performance of official\nacts in respect to instruments in the manner and form and as otherwise authorized\nby law, instruments may be acknowledged, documents attested, oaths and\naffirmations administe red, depositions and affidavits executed, and other such\nofficial acts performed, before or by any commissioned officer in active service of\nthe Armed Forces of the United States for any person who either\n(a) Is a member of the Armed Forces of the United States, or\n(b) Is serving as a merchant seaman outside the limits of the United States, or\n(c) Is outside said limits by permission, assignment or direction of any\ndepartment or official of the United States government.\n(2) Such acknowledgment of instru ments, attestation of documents, administration of\noaths and affirmations, execution of depositions and affidavits, and performance of\nother notarial acts, heretofore or hereafter made or taken, are hereby declared legal,\nvalid and binding, and instruments  and documents so acknowledged, authenticated,\nor sworn to shall be admissible in evidence and eligible to record in this state under\nthe same circumstances, and with the same force and effect as if such\nacknowledgment, attestation, oath, affirmation, depo sition, affidavit, or other\nofficial act, had been made or taken within this state before or by a duly qualified\nofficer or official and under his appropriate certificate and seal of office as\notherwise provided by law.\n(3) In the taking of acknowledgment s and the performing of other notarial acts\nrequiring certification, a certificate endorsed upon or attached to the instrument or\ndocument, which shows the date of the notarial act and which states, in substance,\nthat the person appearing before the office r acknowledges the instrument as his act\nor made or signed the instrument or document under oath, shall be sufficient for all\nintents and purposes.\n(4) When the official signature of any such commissioned officer appears upon such\ninstrument, document or certificate, it shall be prima facie evidence that the person\nmaking such oath or acknowledgment is within the purview of this section.","path":["KRS Chapter 384"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=35768","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:14Z","sha256":"c19e4c95d659fd51da79c928de6f7f9923a5fcb0707a445d95646ad3e666464b","source_id":"us-ky","stale":false,"prev":"us-ky/krs-384.070","next":"us-ky/krs-384.090"},"notice":"GroundRules: Original legal text.
