{"data":{"id":"us-ky/krs-385.062","jurisdiction":"us-ky","citation":"KRS 385.062","heading":"Other transfer by fiduciary.","body":"(1) Subject to subsection (3) of this section, a personal representative or trustee may\nmake an irrevocable transfer to another adult or trust company as custodian for the\nbenefit of a minor pursuant to KRS 385.092, in the absence of a will or under a will\nor trust that does not contain an authorization to do so.\n(2) Subject to subsection (3) of this section, a conservator may make an irrevocable\ntransfer to another adult or trust company as custodian for the benefit of the minor\npursuant to KRS 385.092.\n(3) A transfer under subsection (1) or (2) of this section may be made only if:\n(a) The personal representative, trustee, or conservator considers the transfer to be\nin the best interest of the minor;\n(b) The transfer is not prohibited by or inconsistent with pr ovisions of the\napplicable will, trust agreement, or other governing instrument; and\n(c) The transfer is authorized by the court if it exceeds ten thousand dollars\n($10,000) in value.","path":["KRS Chapter 385"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=35787","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:15Z","sha256":"a7f2c9b024357405a37e76b515618b871a3623ea82404447def2aeb7e386e40f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-385.061","next":"us-ky/krs-385.070"},"notice":"GroundRules: Original legal text.
