Registered in the name of the transferor, an adult other than the\ntransferor, or a trust company, followed in substance by the words: \"as\ncustodian for ------------------------------------------- (name of minor) under\nthe Kentucky Uniform Transfers to Minors Act\"; or\n2. Delivered if in certificated form, or any document necessary for the\ntransfer of an uncertificated security is delivered, together with any\nnecessary endorsement to an adult other than the transferor or to a trust\ncompany as custodian, accompanied by an instrument in substantially\nthe form set forth in subsection (2) of this section;\n(b) Money is paid or delivered to a broker or financial institution for credit to an\naccount in the name of the transferor, an adult other than t he transferor, or a\ntrust company, followed in substance by the words: \"as custodian for\n-------------------------------------------- (name of minor) under the Kentucky\nUniform Transfers to Minors Act\";\n(c) The ownership of a life or endowment insurance policy or annuity contract is\neither:\n1. Registered with the issuer in the name of the transferor, an adult other\nthan the transferor, or a trust company, followed in substance by the\nwords: \"as custodian for ---------------------------------------------- (name of\nminor) under the Kentucky Uniform Transfers to Minors Act\"; or\n2. Assigned in a writing delivered to an adult other than the transferor or to\na trust company whose name in the assignment is followed in substance\nby the words: \"as custodian for -------------------------------------- (name of\nminor) under the Kentucky Uniform Transfers to Minors Act\";\n(d) An irrevocable exercise of a power of appointment or an irrevocable present\nright to future payment under a contract is the subject of a written no tification\ndelivered to the payor, issuer, or other obligor that the right is transferred to\nthe transferor, an adult other than the transferor, or a trust company, whose\nname in the notification is followed in substance by the words: \"as custodian\nfor ------------------------------------------------------------- (name of minor) under\nthe Kentucky Uniform Transfers to Minors Act\";\n(e) An interest in real property is recorded in the name of the transferor, an adult\nother than the transferor, or a trust compa ny, followed in substance by the\nwords: \"as custodian for ---------------------------------------------------- (name of\nminor) under the Kentucky Uniform Transfers to Minors Act\";\n(f) A certificate of title issued by a department or agency of a state or of  the\nUnited States which evidences title to tangible personal property is either:\n1. Issued in the name of the transferor, an adult other than the transferor, or\na trust company, followed in substance by the words: \"as custodian for\n----------------------------------------------------- (name of minor) under the\nKentucky Uniform Transfers to Minors Act\"; or\n2. Delivered to an adult other than the transferor or to a trust company,\nendorsed to that person followed in substance by the wor ds: \"as\ncustodian for --------------------------------------------------- (name of minor)\nunder the Kentucky Uniform Transfers to Minors Act\"; or\n(g) An interest in any property not described in paragraphs (a) through (f) of this\nsubsection is transferred to an adult other than the transferor or to a trust\ncompany by a written instrument in substantially the form set forth in\nsubsection (2) of this section.\n(2) An instrument in the following form satisfies the requirements of paragraphs (a)2.\nand (g) of subsection (1) of this section:\n\"TRANSFER UNDER THE KENTUCKY\nUNIFORM TRANSFERS TO MINORS ACT\nI, ------------------------------- (name of transferor or name and representative capacity\nif a fiduciary) hereby transfer to ----------------------------- (name of custodian), as\ncustodian for --------------------------------- (name of minor) under the Kentucky Uniform\nTransfers to Minors Act, the following: (insert a description of the custodial property\nsufficient to identify it).\nDated: -------------------------------\n------------------------------------------------- (Signature)\n-------------------------------------------------------- (name of custodian) acknowledges receipt\nof the property described above as custodian for the minor named above under the\nKentucky Uniform Transfers to Minors Act.\nDated: -------------------------------\n-------------------------------------------------\"\n(Signature of Custodian)\n(3) A transferor shall place the custodian in control of the custodial property as soon as\npracticable.","path":["KRS Chapter 385"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=35796","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:15Z","sha256":"71410357759cc1470bb698f4cd5f5cbb44ce414ec828f688e2974fd4ebfb7190","source_id":"us-ky","stale":false,"prev":"us-ky/krs-385.091","next":"us-ky/krs-385.100"},"notice":"GroundRules: Original legal text.
