{"data":{"id":"us-ky/krs-385.112","jurisdiction":"us-ky","citation":"KRS 385.112","heading":"Validity and effect of transfer.","body":"(1) The validity of a transfer made in a manner prescribed in KRS 385.032 to 385.222\nis not affected by:\n(a) Failure of the transferor to comply with KRS 385.092(3) concerning\npossession and control;\n(b) Designation of an ineligible custodian, except designati on of the transferor in\nthe case of property for which the transferor is ineligible to serve as custodian\nunder KRS 385.092(1); or\n(c) Death or incapacity of a person nominated under KRS 385.032 or designated\nunder KRS 385.092 as custodian or the disclaimer of the office by that person.\n(2) A transfer made pursuant to KRS 385.092 is irrevocable, and the custodial property\nis indefeasibly vested in the minor, but the custodian has all the rights, powers,\nduties, and authority provided in KRS 385.032 to 385.2 22, and neither the minor\nnor the minor's legal representative has any right, power, duty, or authority with\nrespect to the custodial property except as provided in KRS 385.032 to 385.222.\n(3) By making a transfer, the transferor incorporates in the disposition all the provisions\nof KRS 385.032 to 385.222 and grants to the custodian, and to any third person\ndealing with a person designated as custodian, the respective powers, rights, and\nimmunities provided in KRS 385.032 to 385.222.","path":["KRS Chapter 385"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=35801","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:15Z","sha256":"b6a03021cd5d8b680be3e04c6ca55a449d8227ab086f5efe6cd845f2d1ae1cda","source_id":"us-ky","stale":false,"prev":"us-ky/krs-385.110","next":"us-ky/krs-385.120"},"notice":"GroundRules: Original legal text.
