{"data":{"id":"us-ky/krs-385.172","jurisdiction":"us-ky","citation":"KRS 385.172","heading":"Liability to third persons.","body":"(1) A claim based on:\n(a) A contract entered into by a custodian  acting in a custodial capacity;\n(b) An obligation arising from the ownership or control of custodial property; or\n(c) A tort committed during the custodianship, may be asserted against  the\ncustodial property by proc eeding against the custodian in the custodial\ncapacity, whether or not the custodian or the minor is personally liable\ntherefor.\n(2) A custodian is not personally liable:\n(a) On a contract properly entered into in the custodial capacity unless the\ncustodian fails to reveal that capacity and to identify the custodianship in the\ncontract; or\n(b) For an obligation arising from control of custodial property or for a tort\ncommitted during the custodianship unless the custodian is personally at fault.\n(3) A minor  is not personally liable for an obligation arising from ownership of\ncustodial property or for a tort committed during the custodianship unless the minor\nis personally at fault.","path":["KRS Chapter 385"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=35813","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:15Z","sha256":"8f226198afb773b4525111134f0b3dd9f4e75045eeaeff013c5bc4db23604434","source_id":"us-ky","stale":false,"prev":"us-ky/krs-385.170","next":"us-ky/krs-385.180"},"notice":"GroundRules: Original legal text.
