{"data":{"id":"us-ky/krs-386.025","jurisdiction":"us-ky","citation":"KRS 386.025","heading":"Restrictions on investment in own stock by bank or trust company acting","body":"as fiduciary.\nNo bank or trust company empowered to act as a fiduciary under the laws of this state,\nshall purchase shares of its own capital stock or shares of the capital stock of an affiliated\ninstitution as an investment for any estate or trust under its management, unless expressly\nauthorized so to do by the instrument creating the estate or trust, or unless acquired\nthrough the exercise of rights issued in respect to stock or iginally received; provided\nhowever, if shares of its own capital stock or shares of the capital stock of an affiliated\ninstitution are received by any such bank or trust company direct from the testator or\ndonor, as an original investment in an estate or trust, the fact that they are shares in the\nfiduciary institution, or an affiliate thereof, shall not, of itself, be sufficient to cause them\nto be considered improper investments, regardless of the number of said shares or value\nthereof, but said shares together with any additional shares subsequently acquired through\nthe exercise of rights issued in respect thereto shall be regarded as proper trust\ninvestments in the hands of such fiduciary bank or trust company, if they would be so\nregarded if held by an individual acting in such fiduciary capacity.","path":["KRS Chapter 386"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=35828","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:15Z","sha256":"6359514928d3c5d6005ecf58b2a38a42a162058d122dc5b227c4e1cb92ef04b1","source_id":"us-ky","stale":false,"prev":"us-ky/krs-386.023","next":"us-ky/krs-386.030"},"notice":"GroundRules: Original legal text.
