{"data":{"id":"us-ky/krs-386.170","jurisdiction":"us-ky","citation":"KRS 386.170","heading":"Nonresident trustee for personal property of nonresident beneficiary --","body":"Power to act in this state.\n(1) Where the beneficial owner of personal estate, held and controlled for his benefit or\nthe benefit of his children or heirs by a trustee, is a nonre sident of this state and has\nno trustee in this state, his trustee, appointed and qualified according to the laws of\nthe place where the person resides, may collect, receive and remove to such place of\nresidence any personal estate of the person or cestui que trust located in this state.\n(2) Upon application by petition in a summary way, the Circuit Court having\njurisdiction may authorize the foreign trustee to sue for, recover and remove any\nsuch personal estate of the nonresident cestui que trust, or to o therwise act as a\ntrustee appointed in this state.\n(3) The court shall not grant the petition or authorize the collection or removal of such\nproperty unless it is satisfied by documentary evidence that the foreign trustee has,\nwhere he qualified, given bond with good and sufficient surety to account for all the\nestate of the nonresident cestui que trust that might come to his hands, nor unless\nthe court is satisfied that neither the nonresident cestui que trust nor any person\nhaving a present, future or con tingent interest in the personal estate will be\nprejudiced by the order.\n(4) The venue for such action shall lie in the county where there is jurisdiction in the\nDistrict Court to appoint a trustee for the nonresident person.","path":["KRS Chapter 386"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=35846","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:15Z","sha256":"87cad350f7f772b7dcfb258ea1b5b4fdd2a3ae8cb14c976c87b80d8a73e69e82","source_id":"us-ky","stale":false,"prev":"us-ky/krs-386.165","next":"us-ky/krs-386.175"},"notice":"GroundRules: Original legal text.
