{"data":{"id":"us-ky/krs-386a.2-010","jurisdiction":"us-ky","citation":"KRS 386A.2-010","heading":"Certificate of trust.","body":"(1) A statutory trust is formed when a certificate of trust that complies with subsection\n(2) of this section and filed by the Secretary of State is effective as determined\nunder KRS 14A.2-070.\n(2) A certificate of trust must state:\n(a) The name of the statutory trust, which must comply with KRS 14A.3-010;\n(b) The name and business address of each person who, upon formation of the\ntrust, will be a trustee;\n(c) The mailing address of the principal office of the trust;\n(d) The name and street address of the trust 's initial registered office and\nregistered agent that comply with KRS 14A.4-010; and\n(e) The name and business address of the person executing the certificate of trust\nas the organizer thereof.\n(3) If the trust may have one (1) or more series, the certifi cate of trust must contain a\nstatement to that effect as provided in KRS 386A.4-020(2)(c).\n(4) A certificate of trust may contain any term required or permitted to be set forth in\nthe trust instrument.\n(5) A filed certificate of trust, statement of cancell ation, statement of change or articles\nof conversion or merger prevail over inconsistent terms of a trust instrument.\n(6) That the certificate of trust is on file with the Secretary of State is notice:\n(a) That the statutory trust formed by the certificat e of trust is a statutory trust\nformed under the laws of the Commonwealth of Kentucky;\n(b) Of all other facts set forth in the certificate which are required to be set forth\nby subsection (2) of this section; and\n(c) Of any statement made pursuant to subsection (3) of this section.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=40349","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:17Z","sha256":"f0d4179fa549a18030e48da2080c3a150603e607a8cdae0e77170aab01e70907","source_id":"us-ky","stale":false,"prev":"us-ky/krs-386a.10-040","next":"us-ky/krs-386a.2-020"},"notice":"GroundRules: Original legal text.
