{"data":{"id":"us-ky/krs-386a.5-110","jurisdiction":"us-ky","citation":"KRS 386A.5-110","heading":"Delegation by trustee.","body":"(1) A trustee may delegate duties and powers, including to a co -trustee. The trustee\nshall exercise the care that a person in a similar position would reasonably believe\nappropriate under similar circumstances in:\n(a) Selecting an agent;\n(b) Establishing the scope and terms of the delegation; and\n(c) Periodically reviewing the agent's actions in order to monitor the agent's\nperformance and compliance with the terms of the delegation.\n(2) In performing a delegated function, an agent of a trustee owes a duty to the statutory\ntrust to comply with the terms of the delegation and to act with the care,\ncompetence, and diligence normally exercised by agents in similar circumstances.\n(3) A trustee that delegates duties and powers as provided in subsection (1) of this\nsection is responsible to the statutory trust and the beneficial owners for the conduct\nof the agent in the performance of all delegated duties and powers.\n(4) An agent of a trustee submits to the jurisdiction of the courts of this Commonwealth\nby accepting a delegation of powers or duties from a trustee with respect to a claim\nrelated to the agency.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=40385","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:18Z","sha256":"58157cdbeaba47bb463aaec7364293187a08e97ce02ef0b4b652680e0c7fca79","source_id":"us-ky","stale":false,"prev":"us-ky/krs-386a.5-100","next":"us-ky/krs-386a.5-120"},"notice":"GroundRules: Original legal text.
