{"data":{"id":"us-ky/krs-386a.9-010","jurisdiction":"us-ky","citation":"KRS 386A.9-010","heading":"Foreign statutory trusts.","body":"(1) The law of the jurisdiction of formation of a foreign statutory trust governs:\n(a) The internal affairs of the trust, including the liability of a beneficial owner as\nbeneficial owner and trustee as trustee for a debt, obligation, or other liability\nof the trust or a series thereof and the right of a beneficial owner to inspect\nbooks and records; and\n(b) The enforceability of a debt, obligation, or other liability of the foreign\nstatutory trust or any series thereof against the property of the trust or the\nproperty of or associated with a series.\n(2) Each foreign statutory trust is subject to KRS Chapter 14A.\n(3) The Secretary of State may not deny a foreign statutory trust a certificate of\nauthority because of any difference between the law of its jurisdict ion of formation\nand the laws of this Commonwealth.\n(4) A certificate of authority does not authorize a foreign statutory trust to engage in\nany business or exercise any power that a statutory trust may not engage in or\nexercise in this Commonwealth.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=40414","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:18Z","sha256":"0dab9d06e8c613b8c145cea11b960e67f3ee19183100f667a1edd1baa1cc8df4","source_id":"us-ky","stale":false,"prev":"us-ky/krs-386a.8-080","next":"us-ky/krs-386b.1-010"},"notice":"GroundRules: Original legal text.
