{"data":{"id":"us-ky/krs-386b.10-050","jurisdiction":"us-ky","citation":"KRS 386B.10-050","heading":"Limitation of action against trustee.","body":"(1) For the purposes of this section, a \"report\" is an account statement or other form of\nwritten disclosure made by the trustee to the beneficiary.\n(2) A beneficiary may not commence a proceeding against a trustee for breach of trust\nmore than one (1) year af ter the date the beneficiary or a representative of the\nbeneficiary was sent a report that adequately disclosed the existence of a potential\nclaim for breach of trust and informed the beneficiary of the time allowed for\ncommencing a proceeding.\n(3) A report adequately discloses the existence of a potential claim for breach of trust if\nit provides sufficient information so that the beneficiary or representative knows of\nthe potential claim or should have inquired into its existence.\n(4) If subsection (2) of this section does not apply, a judicial proceeding by a\nbeneficiary against a trustee for breach of trust shall be commenced within five (5)\nyears of discovery of an injury by a trustee to the rights of the beneficiary.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=44668","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:19Z","sha256":"16d436ca044ae3b5ce8adef6ea2c07c494d8644625167676ccf46fed3b52398e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-386b.10-040","next":"us-ky/krs-386b.10-060"},"notice":"GroundRules: Original legal text.
