{"data":{"id":"us-ky/krs-386b.10-110","jurisdiction":"us-ky","citation":"KRS 386B.10-110","heading":"Protection of person dealing with trustee.","body":"(1) A person other than a beneficiary who in good faith assists a trustee, or who in good\nfaith and for value deals with a trustee, without knowledge that the trustee is\nexceeding or improperly exercising the trustee's powers is protected from liability as\nif the trustee properly exercised the power.\n(2) A person other than a beneficiary who in good faith deals with a trustee is not\nrequired to inquire into the extent of the trustee's powers or the propriety of their\nexercise.\n(3) A person who in good faith del ivers assets to a trustee need not ensure their proper\napplication.\n(4) A person other than a beneficiary who in good faith assists a former trustee, or who\nin good faith and for value deals with a former trustee, without knowledge that the\ntrusteeship has terminated is protected from liability as if the former trustee were\nstill a trustee.\n(5) Comparable protective provisions of other laws relating to commercial transactions\nor transfer of securities by fiduciaries prevail over the protection provided by t his\nsection.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=43152","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:19Z","sha256":"229c32018606615442f18f3f195fb8e250a01a6e953c88c7da88baec5dffac9a","source_id":"us-ky","stale":false,"prev":"us-ky/krs-386b.10-100","next":"us-ky/krs-386b.10-120"},"notice":"GroundRules: Original legal text.
