{"data":{"id":"us-ky/krs-386b.10-120","jurisdiction":"us-ky","citation":"KRS 386B.10-120","heading":"Certification of trust.","body":"(1) Instead of furnishing a copy of the trust instrument to a person other than a\nbeneficiary, the trustee may furnish to the person a certification of trust containing\nthe following information:\n(a) That the trust exists and the date the trust instrument was signed;\n(b) The identity of the settlor;\n(c) The identity and address of the currently acting trustee;\n(d) The powers of the trustee;\n(e) The revocability or irrevocability of the trust and the identity of any person\nholding a power to revoke the trust;\n(f) The authority of cotrustees to sign or otherwise authenticate and whether all or\nless than all are required in order to exercise powers of the trustee; and\n(g) The manner of taking title to trust property.\n(2) A certification of trust may be signed or otherwise authenticated by any trustee.\n(3) A certification of trust shall state that the trust has not been revoked, modified, or\namended in any manner that would cause the representations contained in the\ncertification of trust to be incorrect.\n(4) A certification of trust need not contain the dispositive terms of a trust.\n(5) A recipient of a certification of trust may require the trustee to furnish copies of\nthose excerpts from the original trust instrument and later amendments which\ndesignate the trustee  and confer upon the trustee the power to act in the pending\ntransaction.\n(6) A person who acts in reliance upon a certification of trust without knowledge that\nthe representations contained therein are incorrect is not liable to any person for so\nacting and may assume without inquiry the existence of the facts contained in the\ncertification. Knowledge of the terms of the trust may not be inferred solely from\nthe fact that a copy of all or part of the trust instrument is held by the person relying\nupon the certification.\n(7) A person who in good faith enters into a transaction in reliance upon a certification\nof trust may enforce the transaction against the trust property as if the\nrepresentations contained in the certification were correct.\n(8) A person making a demand for the trust instrument in addition to a certification of\ntrust or excerpts is liable for damages if the court determines that the person did not\nact in good faith in demanding the trust instrument.\n(9) This section shall not limi t the right of a person to obtain a copy of the trust\ninstrument in a judicial proceeding concerning the trust.\n(10) The District Court shall have exclusive jurisdiction over matters under this section.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=43153","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:19Z","sha256":"be1eae74f9c3623740cf0419208a3c4e7018ca11549ee143d1716dd7d4731299","source_id":"us-ky","stale":false,"prev":"us-ky/krs-386b.10-110","next":"us-ky/krs-386b.11-010"},"notice":"GroundRules: Original legal text.
