{"data":{"id":"us-ky/krs-386b.12-080","jurisdiction":"us-ky","citation":"KRS 386B.12-080","heading":"Duty and liability of directed trustee.","body":"(1) Subject to subsection (2) of this section, a directed trustee shall take reasonable\naction to comply with a trust director's exercise or nonexercise of a power of\ndirection or further power under KRS 386B.12 -050(2)(a), and the trustee is not\nliable for the action.\n(2) A directed trustee shall not comply with a trust director's exercise or nonexercise of\na power of direction or further power under KRS 386B.12 -050 to the extent that by\ncomplying, the trustee would engage in willful misconduct.\n(3) An exercise  of a power of direction under which a trust director may release a\ntrustee or another trust director from liability for breach of trust is not effective if:\n(a) The breach involved the trustee's or other director's willful misconduct;\n(b) The release was induced by improper conduct of the trustee or other director\nin procuring the release; or\n(c) At the time of the release, the director did not know the material facts relating\nto the breach.\n(4) A directed trustee that has reasonable doubt about its duty u nder this section may\npetition a court with jurisdiction under Subchapter 2 of KRS Chapter 386B for\ninstructions.\n(5) The terms of a trust may impose a duty or liability on a directed trustee in addition\nto the duties and liabilities under this section.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57740","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:19Z","sha256":"243176cd89ac8b89e440fd5cd89ab84385970f815c1bdcd6785c04c281287917","source_id":"us-ky","stale":false,"prev":"us-ky/krs-386b.12-070","next":"us-ky/krs-386b.12-090"},"notice":"GroundRules: Original legal text.
