{"data":{"id":"us-ky/krs-386b.13-020","jurisdiction":"us-ky","citation":"KRS 386B.13-020","heading":"Scope of subchapter.","body":"(1) Except as otherwise provided in subsections (2) and (3) of this section, the\nprovisions of KRS 386B.13-010 to 386B.13-280 shall apply to an express trust that\nis irrevocable or revocable by the settlor only with the consent of the trustee or a\nperson holding an adverse interest.\n(2) KRS 386B.13 -010 to 386B.13 -280 shall not apply to a trust held solely for\ncharitable purposes.\n(3) Subject to KRS 386B.13-140, a trust instrument may restrict or prohibit exercise of\nthe decanting power.\n(4) KRS 386B.13-010 to 386B.13-280 do not limit the power of a trustee, powerholder,\nor other person to distribute or appoint property in further trust or to modify a trust\nunder the trust instrument, statutes of this Commonwealth other than the provisions\nof KRS 386B.13-010 to 386B.13-280, common law, a court order, or a nonjudicial\nsettlement agreement.\n(5) KRS 386B.13-010 to 386B.13-280 do not affect the ability of a settlor to provide in\na trust instrument for the distribution of the trust property or appointment in further\ntrust of the trust property or for modification of the trust instrument.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57751","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:20Z","sha256":"a3af2c6308f0751ce3b57d9291e064792859bda1cfb234520dadd320844a66ac","source_id":"us-ky","stale":false,"prev":"us-ky/krs-386b.13-010","next":"us-ky/krs-386b.13-030"},"notice":"GroundRules: Original legal text.
