{"data":{"id":"us-ky/krs-386b.13-140","jurisdiction":"us-ky","citation":"KRS 386B.13-140","heading":"Trust limitation on decanting power.","body":"(1) An authorized fiduciary may not exercise the decanting power to the extent the\nfirst-trust instrument expressly prohibits the exercise of:\n(a) The decanting power; or\n(b) A power granted by state law to the fiduciary to distribute part or all of the\nprincipal of the trust to another trust or to modify the trust.\n(2) Exercise of the decanting power is subject to any restriction in the first -trust\ninstrument that expressly applies to the exercise of:\n(a) The decanting power; or\n(b) A power granted by state la w to a fiduciary to distribute part or all of the\nprincipal of the trust to another trust or to modify the trust.\n(3) A general prohibition of the amendment or revocation of a first trust, a spendthrift\nclause, or a clause restraining the voluntary or involuntary transfer of a beneficiary's\ninterest does not preclude exercise of the decanting power.\n(4) Subject to subsections (1) and (2) of this section, an authorized fiduciary may\nexercise the decanting power under KRS 386B.13 -010 to 386B.13 -280 even if th e\nfirst-trust instrument permits the authorized fiduciary or another person to modify\nthe first-trust instrument or to distribute part or all of the principal of the first trust\nto another trust.\n(5) If a first-trust instrument contains an express prohibition described in subsection (1)\nof this section or an express restriction described in subsection (2) of this section,\nthe provision shall be included in the second-trust instrument.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57763","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:20Z","sha256":"b32a9d1ee1fe146eb810a54f63ac6aa41feb784e7af6cda227aa1555c6535023","source_id":"us-ky","stale":false,"prev":"us-ky/krs-386b.13-130","next":"us-ky/krs-386b.13-150"},"notice":"GroundRules: Original legal text.
