{"data":{"id":"us-ky/krs-386b.13-150","jurisdiction":"us-ky","citation":"KRS 386B.13-150","heading":"Change in compensation.","body":"(1) If a first -trust instrument specifies an authorized fiduciary's compensation, the\nfiduciary may not exercise the decanting power to increase the fiduciary's\ncompensation above the specified compensation unless:\n(a) All qualified beneficiaries of the second  trust consent to the increase in a\nsigned record; or\n(b) The increase is approved by the court.\n(2) If a first -trust instrument does not specify an authorized fiduciary's compensation,\nthe fiduciary may not exercise the decanting power to increase the fid uciary's\ncompensation above the compensation permitted by this chapter unless:\n(a) All qualified beneficiaries of the second trust consent to the increase in a\nsigned record; or\n(b) The increase is approved by the court.\n(3) A change in an authorized fiduc iary's compensation which is incidental to other\nchanges made by the exercise of the decanting power is not an increase in the\nfiduciary's compensation for purposes of subsections (1) and (2) of this section.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57764","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:20Z","sha256":"0fa57ec98a168184bfcad2a504624974f2dfb3b3453a1a48c6cbf9d4c1c438a1","source_id":"us-ky","stale":false,"prev":"us-ky/krs-386b.13-140","next":"us-ky/krs-386b.13-160"},"notice":"GroundRules: Original legal text.
