{"data":{"id":"us-ky/krs-386b.13-160","jurisdiction":"us-ky","citation":"KRS 386B.13-160","heading":"Relief from liability and indemnification.","body":"(1) Except as otherwise provided in this section, a second -trust instrument may not\nrelieve an authorized fiduciary from liability for breach of trust to a greater extent\nthan the first-trust instrument.\n(2) A second -trust instrument may provide for indemnific ation of an authorized\nfiduciary of the first trust or another person acting in a fiduciary capacity under the\nfirst trust for any liability or claim that would have been payable from the first trust\nif the decanting power had not been exercised.\n(3) A second-trust instrument may not reduce fiduciary liability in the aggregate.\n(4) Subject to subsection (3) of this section, a second -trust instrument may divide and\nreallocate fiduciary powers among the fiduciaries, including one (1) or more\ntrustees, distrib ution advisors, investment advisors, trust protectors, or other\npersons, and relieve a fiduciary from liability for an act or failure to act of another\nfiduciary as permitted by law of this Commonwealth other than KRS 386B.13 -010\nto 386B.13-280.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57765","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:20Z","sha256":"aa09bc8b76c9ca4016278b664dad8891d00d94ef05415268ad02fb19e4e7b283","source_id":"us-ky","stale":false,"prev":"us-ky/krs-386b.13-150","next":"us-ky/krs-386b.13-170"},"notice":"GroundRules: Original legal text.
