{"data":{"id":"us-ky/krs-386b.13-250","jurisdiction":"us-ky","citation":"KRS 386B.13-250","heading":"Later-discovered property.","body":"(1) Except as otherwise provided in subsection (3) of this section, if exercise of the\ndecanting power was intended to distribute all the principal of the first trust to one\n(1) or more second trusts, later -discovered property belonging to the first trust and\nproperty paid to or acquired by the first trust after the exercise of the power is part\nof the trust estate of the second trust or trusts.\n(2) Except as otherwise provided in subsection (3) of this section, if exercise of the\ndecanting power was intended t o distribute less than all the principal of the first\ntrust to one (1) or more second trusts, later -discovered property belonging to the\nfirst trust or property paid to or acquired by the first trust after exercise of the power\nremains part of the trust estate of the first trust.\n(3) An authorized fiduciary may provide in an exercise of the decanting power or by\nthe terms of a second trust for disposition of later -discovered property belonging to\nthe first trust or property paid to or acquired by the first trust after exercise of the\npower.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57774","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:20Z","sha256":"ba591c6ad6d9eb30b8f0a0c04684798deef97164fb961abd0f8353835b992946","source_id":"us-ky","stale":false,"prev":"us-ky/krs-386b.13-240","next":"us-ky/krs-386b.13-260"},"notice":"GroundRules: Original legal text.
