{"data":{"id":"us-ky/krs-386b.2-050","jurisdiction":"us-ky","citation":"KRS 386B.2-050","heading":"Registration of trust.","body":"(1) The trustee of a trust having its principal place of administration in this\nCommonwealth shall register the trust in the District Court of this Commonwealth\nat the principal place of administration. Unless otherwise designated in the trust\ninstrument, the principal place of administration of a trust is the trustee's usual place\nof business where the records pertaining to the trust are kept, or at the trustee's\nresidence if he or she has no such place of business. In the case of cotrustees, the\nprincipal place of administration, if not otherwise designated in the trust instrument,\nis:\n(a) 1. The usual place of business of the corporate trustee if there is but one (1)\ncorporate cotrustee; or\n2. The usual place of business or residence of the individual truste e who is\na professional fiduciary if there is but one (1) such person and no\ncorporate cotrustee; and\n(b) In all other cases, the usual place of business or residence of any of the\ncotrustees as agreed on by them.\nThe duty to register under this section s hall not apply to the trustee of a trust if\nregistration would be inconsistent with the retained jurisdiction of a foreign court\nfrom which the trustee cannot obtain release, nor does the duty to register under this\nsection apply to any trust, whether test amentary or inter vivos, revocable or\nirrevocable, unless the settlor of the trust so directs.\n(2) Registration shall be accomplished by filing a statement indicating the name and\naddress of the trustee in which he or she acknowledges the trusteeship. The\nstatement shall indicate whether the trust has been registered elsewhere. The\nstatement shall identify the trust:\n(a) In the case of a testamentary trust, by the name of the testator and the date and\nplace of domiciliary probate;\n(b) In the case of a writ ten inter vivos trust, by the name of each settlor and the\noriginal trustee and the date of the trust instrument; or\n(c) In the case of an oral trust, by information identifying the settlor or other\nsource of funds and describing the time and manner of th e trust's creation and\nthe terms of the trust, including the subject matter, beneficiaries, and time of\nperformance.\nIf a trust has been registered elsewhere, registration in this Commonwealth is\nineffective until the earlier registration is released by o rder of the court where prior\nregistration occurred, or an instrument signed by the trustee and all beneficiaries is\nfiled with the registration in this state.\n(3) (a) By registering a trust, or accepting the trusteeship of a registered trust, the\ntrustee submits personally to the jurisdiction of the court in any proceeding\nunder this chapter relating to the trust that may be initiated by any interested\nperson while the trust remains registered. Notice of any proceeding shall be\ngiven pursuant to KRS 386B.1-070.\n(b) To the extent of their interests in the trust, all beneficiaries of a trust properly\nregistered in this Commonwealth are subject to the jurisdiction of the court of\nregistration for the purposes of proceedings under this chapter, provided\nnotice is given pursuant to KRS 386B.1-070.\n(c) The court for good cause shown may provide for a different method or time of\ngiving notice for any hearing.\n(4) A trustee who fails to register a trust in a proper place pursuant to this chapter, for\npurposes of any proceedings initiated by a beneficiary of the trust prior to\nregistration, is s ubject to the personal jurisdiction of any court in which the trust\ncould have been registered.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=43080","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:18Z","sha256":"c255dadd8dfa3fa60a23d068d8d14f4bc225b83ae29211669c4c7beab6b448d2","source_id":"us-ky","stale":false,"prev":"us-ky/krs-386b.2-040","next":"us-ky/krs-386b.3-010"},"notice":"GroundRules: Original legal text.
