{"data":{"id":"us-ky/krs-386b.3-010","jurisdiction":"us-ky","citation":"KRS 386B.3-010","heading":"Representations -- Basic effect.","body":"(1) Notice to a person who may represent and bind another person under this\nsubchapter has the same effect as if notice were given directly to the other person.\n(2) The consent of a person who may represent and bind another person under this\nsubchapter is bind ing on the person represented unless the person represented\nobjects to the representation before the consent would otherwise have become\neffective.\n(3) Except as otherwise provided under KRS 386B.4 -110 and 386B.6 -020, a person\nwho under this subchapter may  represent a settlor who lacks capacity, may receive\nnotice and give a binding consent on the settlor's behalf.\n(4) A settlor may not represent and bind a beneficiary under this subchapter with\nrespect to the termination or modification of a trust under KRS 386B.4-110(1).\n(5) Provisions of this subchapter shall also be applicable to KRS 386B.13 -010 to\n386B.13-280 regarding a trustee's power to appoint principal and income in favor of\na trustee of a second trust and KRS 386.454 regarding a trustee's power to  adjust\nbetween principal and income and conversion to unitrust.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57782","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:18Z","sha256":"871a2c7483a92747548e24af9220d870044d610451094735d0fc5421b2c8e1c5","source_id":"us-ky","stale":false,"prev":"us-ky/krs-386b.2-050","next":"us-ky/krs-386b.3-020"},"notice":"GroundRules: Original legal text.
