{"data":{"id":"us-ky/krs-386b.5-050","jurisdiction":"us-ky","citation":"KRS 386B.5-050","heading":"Overdue distribution.","body":"(1) As used in this section, \"mandatory distribution\" means a distribution of income or\nprincipal which the trustee is required to make to a beneficiary under the terms of\nthe trust, including a distribution on termination of the trust. The term shall not\ninclude a distribution subject to the exercise of the trustee's discretion even if:\n(a) The discretion is expressed in the form of a standard of distribution; or\n(b) The terms of the trust authorizing a distribution couple language of discretion\nwith language of direction.\n(2) Whether or not a trust contains a spendthrift provision, a creditor or assignee of a\nbeneficiary may reach a mandatory distribution of income or principal, including a\ndistribution on termination of the trust, if the trustee has not made the distribution to\nthe beneficiary within a reasonable time after the designated distribution date.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=43107","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:19Z","sha256":"969a9c3788364a6b1f3e3718478d3db2298c711281b12250a115a64a900dcae7","source_id":"us-ky","stale":false,"prev":"us-ky/krs-386b.5-040","next":"us-ky/krs-386b.5-060"},"notice":"GroundRules: Original legal text.
