{"data":{"id":"us-ky/krs-386b.6-040","jurisdiction":"us-ky","citation":"KRS 386B.6-040","heading":"Limitation on action contesting validity of revocable trust --","body":"Distribution of trust property.\n(1) A person may commence a judicial proceeding to contest the validity of a trust that\nwas revocable at the settlor's death within the earlier of:\n(a) Two (2) years after the settlor's death; or\n(b) Ninety (90) days after the trustee sent the person a copy of the trust instrument\nand a notice informing the person of the trust's existence, of the trustee's name\nand address, and of the time allowed for commencing a proceeding.\n(2) Upon the death of the settlor of a trust that was revocable at the settlor's death, the\ntrustee may proceed to distribute the trust property in accordance with the terms of\nthe trust. The trustee is not subject to liability for doing so unless:\n(a) The trustee knows of a pending judicial proceeding contesting the validity of\nthe trust; or\n(b) A potential contestant has notified the trustee of a possible judicial proceeding\nto contest the trust and a judicial proceeding is commenced within sixty (60)\ndays after the contestant sent the notification.\n(3) A beneficiary of a trust that is determined to have been invalid is liable to return any\ndistribution received.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=43112","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:19Z","sha256":"bff831d73961f2120cc8ca70fad494a725123ab2c1151cbb21a9a27bb7a4609f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-386b.6-030","next":"us-ky/krs-386b.7-010"},"notice":"GroundRules: Original legal text.
