{"data":{"id":"us-ky/krs-386b.7-030","jurisdiction":"us-ky","citation":"KRS 386B.7-030","heading":"Cotrustees.","body":"(1) Cotrustees who are unable to reach a unanimous decision may act by majority\ndecision.\n(2) If a vacancy occurs in a cotrusteeship, the remaining cotrustees may act for the\ntrust.\n(3) Subject to KRS 386B.12 -110, a cotrustee shall participate in the performan ce of a\ntrustee's function unless the cotrustee is unavailable to perform the function because\nof absence, illness, disqualification under other law, or other temporary incapacity\nor the cotrustee has properly delegated the performance of the function to a nother\ntrustee.\n(4) If a cotrustee is unavailable to perform duties because of absence, illness,\ndisqualification under other law, or other temporary incapacity, and prompt action\nis necessary to achieve the purposes of the trust or to avoid injury to the trust\nproperty, the remaining cotrustee or a majority of the remaining cotrustees may act\nfor the trust.\n(5) A trustee may not delegate to a cotrustee the performance of a function the settlor\nreasonably expected the trustees to perform jointly. Unless a d elegation was\nirrevocable, a trustee may revoke a delegation previously made.\n(6) Except as otherwise provided in subsection (7) of this section, a trustee who does\nnot join in an action of another trustee is not liable for the action.\n(7) Subject to KRS 386B.12-110, each trustee shall exercise reasonable care to:\n(a) Prevent a cotrustee from committing a breach of trust; and\n(b) Compel a cotrustee to redress a breach of trust.\n(8) A dissenting trustee who joins in an action at the direction of the majority  of the\ntrustees and who notified any cotrustee of the dissent at or before the time of the\naction is not liable for the action unless the action is a breach of trust.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57784","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:19Z","sha256":"185ebec0cd9107da9eaa468c0e91f5e13b3adb653b003f94e4212484c6c8bbe3","source_id":"us-ky","stale":false,"prev":"us-ky/krs-386b.7-020","next":"us-ky/krs-386b.7-040"},"notice":"GroundRules: Original legal text.
