{"data":{"id":"us-ky/krs-386b.8-070","jurisdiction":"us-ky","citation":"KRS 386B.8-070","heading":"Delegation by trustee.","body":"(1) A trustee may delegate duties and powers that a prudent trustee of comparable skills\ncould properly delegate under the circumstances. The trustee shall exercise\nreasonable care, skill, and caution in:\n(a) Selecting an agent;\n(b) Establishing the scope and terms of the delegation, consistent with the\npurposes and terms of the trust; and\n(c) Periodically reviewing the agent's actions in order to monitor the agent's\nperformance and compliance with the terms of the delegation.\n(2) In performing a delegated func tion, an agent owes a duty to the trust to exercise\nreasonable care to comply with the terms of the delegation.\n(3) A trustee who complies with subsection (1) of this section is not liable to the\nbeneficiaries or to the trust for an action of the agent to whom the function was\ndelegated.\n(4) By accepting a delegation of powers or duties from the trustee of a trust that is\nsubject to the law of this Commonwealth, an agent submits to the jurisdiction of the\ncourts of this state.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=43129","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:19Z","sha256":"85fa27d64664787faee338de09204eaa906d0b10eae5e04083017804f7f9ad1e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-386b.8-060","next":"us-ky/krs-386b.8-080"},"notice":"GroundRules: Original legal text.
