{"data":{"id":"us-ky/krs-387.070","jurisdiction":"us-ky","citation":"KRS 387.070","heading":"Bonding of guardian or conservator.","body":"(1) Except as provided in subsections (2) and (3) of this section, no guardian or\nconservator shall act until the guardian or conservator has been appointed by the\nproper District Court, and given bond to the Commonwealth of Kentucky with good\nsurety, either c orporate or personal, approved by the District Court to faithfully\ndischarge the trust of guardian or conservator. The bond shall be carefully kept by\nthe clerk of the District Court in a book to be provided for that purpose.\n(2) A limited guardian shall b e exempt from the requirements of subsection (1) of this\nsection.\n(3) (a) If the person or entity appointed by the District Court as guardian or\nconservator is a person or entity nominated pursuant to KRS 387.040, and the\nwill of the parent making the nomination requests no surety on the bond of the\nguardian or conservator, no surety shall be required on the bond, unless the\nDistrict Court deems it imprudent to dispense with surety because of a change\nof circumstances since the will was made or for other good cause.\n(b) If the District Court directs that the assets of a ward's estate be deposited in a\nrestricted account as set out in KRS 387.122, the guardian or conservator shall\nbe exempt from giving surety on his or her bond.\n(4) No master or other commiss ioner whose duty it is to settle the accounts of a\nguardian or conservator, nor judge or clerk of a court, or practicing attorney, shall\nbe accepted as surety on the bond of a guardian or conservator.","path":["KRS Chapter 387"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=35996","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:20Z","sha256":"c670c5d6f38c8a67bf1d07a649a287fe699862a5d376e82e46472be1a817c8b2","source_id":"us-ky","stale":false,"prev":"us-ky/krs-387.065","next":"us-ky/krs-387.080"},"notice":"GroundRules: Original legal text.
