{"data":{"id":"us-ky/krs-387.510","jurisdiction":"us-ky","citation":"KRS 387.510","heading":"Definitions for KRS 387.500 to 387.770 and 387.990.","body":"As used in KRS 387.500 to 387.770 and 387.990:\n(1) \"Conservator\" means an individual, agency, or corporation appointed by the court to\nmanage the financial resources of a disabled person;\n(2) \"Limited conservator\" means an individual, agency, or corporation appointed by the\ncourt to assist in managing the financial resources of a partially disabled person and\nwhose powers and duties have been specifically enumerated by court order;\n(3) \"Guardian\" means any individual, agency, or corporation appointed by the  court to\nmanage the personal affairs of a disabled person;\n(4) \"Limited guardian\" means an individual, agency, or corporation appointed by the\ncourt to assist in managing the personal affairs of a partially disabled person and\nwhose powers and duties have been specifically enumerated by court order;\n(5) \"Standby\" guardian or conservator means a person or entity designated by the court\nto assume the powers and duties assigned to a limited guardian, guardian, limited\nconservator, or conservator upon his death, resignation, removal, or incapacity;\n(6) \"Testamentary\" guardian or conservator means an individual, agency, or corporation\nnominated in the will of a limited guardian, guardian, limited conservator, or\nconservator to succeed the testator in that capacity upon his death;\n(7) \"Developmental disability\" means a severe, chronic disability of a person which:\n(a) Is attributable to a mental or physical impairment or combination of mental\nand physical impairments, including pervasive developmental disorder;\n(b) Is manifested before the person attains age twenty-two (22);\n(c) Is likely to continue indefinitely;\n(d) Results in substantial functional limitations in three (3) or more of the\nfollowing areas of major life activity:\n1. Self-care;\n2. Receptive and expressive language;\n3. Learning;\n4. Mobility;\n5. Self-direction;\n6. Capacity for independent living; and\n7. Economic self-sufficiency; and\n(e) Reflects the person's need for a combination and sequence of special\ninterdisciplinary or generic care, treatment, or other services which are of\nlifelong or extended duration and are individually planned and coordinated;\n(8) \"Disabled\" means a legal disability, not a medical disability, and is measured by\nfunctional inabilities. It refers to any perso n seventeen (17) years of age or older\nwho is:\n(a) Unable to make informed decisions with respect to his personal affairs to such\nan extent that he lacks the capacity to provide for his physical health and\nsafety, including but not limited to health care, food, shelter, clothing, or\npersonal hygiene; or\n(b) Unable to make informed decisions with respect to his financial resources to\nsuch an extent that he lacks the capacity to manage his property effectively by\nthose actions necessary to obtain, administer,  and dispose of both real and\npersonal property.\nSuch inability shall be evidenced by acts or occurrences within six (6) months prior\nto the filing of the petition for guardianship or conservatorship and shall not be\nevidenced solely by isolated instances  of negligence, improvidence, or other\nbehavior;\n(9) \"Partially disabled\" refers to an individual who lacks the capacity to manage some\nof his personal affairs and/or financial resources as provided in subsection (8) of\nthis section, but who cannot be found to be fully disabled as provided therein;\n(10) \"Mentally ill person\" means a person with substantially impaired capacity to use\nself-control, judgment, or discretion in the conduct of his affairs and social\nrelations, associated with maladaptive behavior  or recognized emotional symptoms\nwhere impaired capacity, maladaptive behavior, or emotional symptoms can be\nrelated to physiological, psychological, or social factors;\n(11) \"Interdisciplinary evaluation report\" means a report of an evaluation of a respondent\nperformed pursuant to the provisions of KRS 387.540 to determine whether he is\npartially disabled or disabled as defined herein;\n(12) \"Interested person or entity\" means an adult relative or friend of the respondent or\nward, an official or representat ive of a public or private agency, corporation, or\nassociation concerned with that person's welfare, or any other person found suitable\nby the court;\n(13) \"Petitioner\" means a person who institutes a proceeding under KRS 387.530;\n(14) \"Respondent\" means an  individual alleged to be a partially disabled or disabled\nperson;\n(15) \"Ward\" means a person for whom a limited guardian, guardian, limited conservator,\nor conservator has been appointed;\n(16) \"Committee\" means a person appointed by the court prior to Jul y 1, 1982, to have\nfull care, custody, and control of a disabled person and his estate; and\n(17) \"Personal affairs\" means decisions regarding the person of an adult, including but\nnot limited to health care, food, shelter, clothing, or personal hygiene.","path":["KRS Chapter 387"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=47468","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:21Z","sha256":"d7c9e5129d59bfd58da66c508be64c7a87dab5c67dada8090e1453b0b20f9c0e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-387.500","next":"us-ky/krs-387.520"},"notice":"GroundRules: Original legal text.
