{"data":{"id":"us-ky/krs-387.600","jurisdiction":"us-ky","citation":"KRS 387.600","heading":"Appointment -- Consideration of preference of respondent.","body":"(1) The court may appoint as limited guardian, guardian, limited conservator, or\nconservator any suitable person or any entity, public or private, capable of\nconducting an active guardianship or conservatorship program. The court shall not\nordinarily or customarily appoint the Cabinet for Health and Family Services or any\nother person or entity, public or private, that is directly providing services to the\nrespondent unless no other suitable person or entity is available and willing to be\nappointed. Appointment  of the Cabinet for Health and Family Services shall be\nconsistent with the provisions of KRS 210.290.\n(2) Prior to the appointment, the court shall make a reasonable effort to question the\nrespondent concerning his preference regarding the person or entit y to be appointed\nlimited guardian, guardian, limited conservator, or conservator, and any preference\nindicated shall be given due consideration. If the respondent has designated another\nas his attorney in fact or agent by executing a power of attorney in writing, that\ndesignation shall be treated as an indication of the respondent's preference as to the\nperson or entity to be appointed as his limited guardian, guardian, limited\nconservator, or conservator, and that preference shall be given due considerati on.\nThe court shall appoint the person or entity best qualified and willing to serve.","path":["KRS Chapter 387"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=36049","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:21Z","sha256":"2686afdca7a8b869aa6a669aa56aab4d1ba2d89a40cdc23f257e4862361b574f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-387.590","next":"us-ky/krs-387.605"},"notice":"GroundRules: Original legal text.
