{"data":{"id":"us-ky/krs-387.760","jurisdiction":"us-ky","citation":"KRS 387.760","heading":"Court costs -- Compensation, commission, and reimbursement for","body":"expenses.\n(1) No court costs shall be charged to a respondent or ward in any proceeding under\nKRS 387.500 to 387.770, if the respondent or ward is a poor person as defined in\nKRS 453.190.\n(2) Limited guardians, guardians, limited conservators and conservators are en titled to\nreasonable compensation for services rendered and to reimbursement for reasonable\nand necessary expenses incurred in the exercise of their assigned guardianship or\nconservatorship duties and powers. Such compensation and reimbursement shall be\npaid from the financial resources of the ward and shall not exceed:\n(a) A commission of not more than six percent (6%) of the income collected by\nthe fiduciary, payable at the time the income is collected; and\n(b) Either, but not both, of the following, as elected by the fiduciary:\n1. An annual commission of three -tenths of one percent (0.3%) of the fair\nmarket value of the real and personal property in the care of the\nfiduciary; or\n2. An annual commission of not more than six percent (6%) of the fair\nmarket value of the principal distributed by the fiduciary, payable at the\ntime the principal is distributed.\nIn the absence of an agreement to the contrary, a commission on income shall be\npaid out of the income of the estate and a commission on principal shall  be paid out\nof the principal of the estate.\n(3) Upon submitted proof showing that in the handling of the estate the fiduciary has\nperformed additional and necessary services which have been unusual or\nextraordinary and not normally incident to the care an d management of a similar\nestate, the court may allow the fiduciary additional compensation as is fair and\nreasonable for the additional services rendered.","path":["KRS Chapter 387"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=36066","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:21Z","sha256":"cc20545f6bda58606af60cbecac54e9870a2bd9fd7a5ec1222e746d2c7b726e2","source_id":"us-ky","stale":false,"prev":"us-ky/krs-387.750","next":"us-ky/krs-387.770"},"notice":"GroundRules: Original legal text.
