{"data":{"id":"us-ky/krs-387.822","jurisdiction":"us-ky","citation":"KRS 387.822","heading":"Definitions for KRS 387.822 to 387.838 -- Significant connection factors.","body":"(1) As used in KRS 387.822 to 387.838:\n(a) \"Emergency\" means a circumstance that likely will result in substantial harm\nto a respondent's health, safety, or welfare, and for which the appointment of a\nguardian is necessary because no other person has autho rity and is willing to\nact on the respondent's behalf;\n(b) \"Home state\" means the state in which the respondent was physically present,\nincluding any period of temporary absence, for at least six (6) consecutive\nmonths immediately before the filing of a petition for a protective order or the\nappointment of a guardian; or if none, the state in which the respondent was\nphysically present, including any period of temporary absence, for at least six\n(6) consecutive months ending within the six (6) months prior to the filing of\nthe petition; and\n(c) \"Significant-connection state\" means a state, other than the home state, with\nwhich a respondent has a significant connection other than mere physical\npresence and in which substantial evidence concerning the responde nt is\navailable.\n(2) In determining under KRS 387.826 and 387.840(5) whether a respondent has a\nsignificant connection with a particular state, the court shall consider:\n(a) The location of the respondent's family and other persons required to be\nnotified of the guardianship or protective proceeding;\n(b) The length of time the respondent at any time was physically present in the\nstate and the duration of any absence;\n(c) The location of the respondent's property; and\n(d) The extent to which the respondent h as ties to the state such as voting\nregistration, state or local tax return filing, vehicle registration, driver's\nlicense, social relationship, and receipt of services.","path":["KRS Chapter 387"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=39708","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:21Z","sha256":"b04ecf543d3bea06b9c6cabd03c6b9d25b9fc80037a219c76944f98edb042d1b","source_id":"us-ky","stale":false,"prev":"us-ky/krs-387.820","next":"us-ky/krs-387.824"},"notice":"GroundRules: Original legal text.
