{"data":{"id":"us-ky/krs-387.826","jurisdiction":"us-ky","citation":"KRS 387.826","heading":"Jurisdiction.","body":"A court of this state has jurisdiction to appoint a guardian or issue a protective order for a\nrespondent if:\n(1) This state is the respondent's home state;\n(2) On the date the petition is filed, this state is a significant-connection state and:\n(a) The respondent does not have a home state or a court of the respondent's home\nstate has declined to exercise jurisdiction because this state is a more\nappropriate forum; or\n(b) The respondent has a home state, a petition for an appointment or order is not\npending in a court of that state or another significant -connection state, and,\nbefore the court makes the appointment or issues the order:\n1. A petition for an appointment or order is not filed in the respondent's\nhome state;\n2. An objection to the court's juris diction is not filed by a person required\nto be notified of the proceeding; and\n3. The court in this state concludes that it is an appropriate forum under the\nfactors set forth in KRS 387.832;\n(3) This state does not have jurisdiction under either subsecti on (1) or (2) of this\nsection, the respondent's home state and all significant -connection states have\ndeclined to exercise jurisdiction because this state is the more appropriate forum,\nand jurisdiction in this state is consistent with the constitutions of  this state and the\nUnited States; or\n(4) The requirements for special jurisdiction under KRS 387.828 are met.","path":["KRS Chapter 387"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=39710","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:21Z","sha256":"1dc2e852585a332a61e283d48f910a7a333f597f49b7addc298c903502ca2fec","source_id":"us-ky","stale":false,"prev":"us-ky/krs-387.824","next":"us-ky/krs-387.828"},"notice":"GroundRules: Original legal text.
