{"data":{"id":"us-ky/krs-387.828","jurisdiction":"us-ky","citation":"KRS 387.828","heading":"Special jurisdiction.","body":"(1) A court of this state lacking jurisdiction under KRS 387.826 has special jurisdiction\nto do any of the following:\n(a) Appoint a guardian in an emergency for a term not exceeding ninety (90) days\nfor a respondent who is physically present in this state;\n(b) Issue a protective order with respect to real or tangible personal property\nlocated in this state; and\n(c) Appoint a guardian or conservator for an incapacitated or protected person for\nwhom a provisional order to transfer the proceeding from another stat e has\nbeen issued under procedures similar to KRS 387.840.\n(2) If a petition for the appointment of a guardian in an emergency is brought in this\nstate and this state was not the respondent's home state on the date the petition was\nfiled, the court shall d ismiss the proceeding at the request of the court of the home\nstate, if any, whether dismissal is requested before or after the emergency\nappointment.","path":["KRS Chapter 387"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=39711","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:21Z","sha256":"e4b3cb5482e701f8753d48769ae5f1ed9c63496f2dacf45a10347dc7b9c4b363","source_id":"us-ky","stale":false,"prev":"us-ky/krs-387.826","next":"us-ky/krs-387.830"},"notice":"GroundRules: Original legal text.
