{"data":{"id":"us-ky/krs-387.832","jurisdiction":"us-ky","citation":"KRS 387.832","heading":"Appropriate forum.","body":"(1) A court of this state having jurisdiction under KRS 387.826 to appoint a guardian or\nissue a protective order may decline to exercise its jurisdiction if it determines at\nany time that a court of another state is a more appropriate forum.\n(2) If a court of  this state declines to exercise its jurisdiction under subsection (1) of\nthis section, it shall either dismiss or stay the proceeding. The court may impose any\ncondition the court considers just and proper, including the condition that a petition\nfor the appointment of a guardian or issuance of a protective order be filed promptly\nin another state.\n(3) In determining whether it is an appropriate forum, the court shall consider all\nrelevant factors, including:\n(a) Any expressed preference of the respondent;\n(b) Whether abuse, neglect, or exploitation of the respondent has occurred or is\nlikely to occur and which state could best protect the respondent from the\nabuse, neglect, or exploitation;\n(c) The length of time the respondent was physically present in or  was a legal\nresident of this or another state;\n(d) The distance of the respondent from the court in each state;\n(e) The financial circumstances of the respondent's estate;\n(f) The nature and location of the evidence;\n(g) The ability of the court in each s tate to decide the issue expeditiously and the\nprocedures necessary to present evidence;\n(h) The familiarity of the court of each state with the facts and issues in the\nproceeding; and\n(i) If an appointment were made, the court's ability to monitor the con duct of the\nguardian or conservator.","path":["KRS Chapter 387"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=39713","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:21Z","sha256":"c1d5f35a7f9cc39b15e7b22cf70d143955db6e3ae0d825605ea7acf0e907ad19","source_id":"us-ky","stale":false,"prev":"us-ky/krs-387.830","next":"us-ky/krs-387.834"},"notice":"GroundRules: Original legal text.
