{"data":{"id":"us-ky/krs-387.840","jurisdiction":"us-ky","citation":"KRS 387.840","heading":"Transfer of guardianship or conservatorship to another state.","body":"(1) A guardian or conservator appointed in this state may petition the court to transfer\nthe guardianship or conservatorship to another state.\n(2) Notice of a petition under subsection (1) of this section shall be given to the persons\nthat would be entitled to  notice of a petition in this state for the appointment of a\nguardian or conservator.\n(3) On the court's own motion or on request of the guardian or conservator, the\nincapacitated or protected person, or other person required to be notified of the\npetition, the court shall hold a hearing on a petition filed pursuant to subsection (1)\nof this section.\n(4) The court shall issue an order provisionally granting a petition to transfer a\nguardianship and shall direct the guardian to petition for guardianship in t he other\nstate if the court is satisfied that the guardianship will be accepted by the court in\nthe other state and the court finds that:\n(a) The incapacitated person is physically present in or is reasonably expected to\nmove permanently to the other state;\n(b) An objection to the transfer has not been made or, if an objection has been\nmade, the objector has not established that the transfer would be contrary to\nthe interests of the incapacitated person; and\n(c) Plans for care and services for the incapacit ated person in the other state are\nreasonable and sufficient.\n(5) The court shall issue a provisional order granting a petition to transfer a\nconservatorship and shall direct the conservator to petition for conservatorship in\nthe other state if the court i s satisfied that the conservatorship will be accepted by\nthe court of the other state and the court finds that:\n(a) The protected person is physically present in or is reasonably expected to\nmove permanently to the other state, or the protected person has a significant\nconnection to the other state considering the factors in KRS 387.822(2);\n(b) An objection to the transfer has not been made or, if an objection has been\nmade, the objector has not established that the transfer would be contrary to\nthe interests of the protected person; and\n(c) Adequate arrangements will be made for management of the protected\nperson's property.\n(6) The court shall issue a final order confirming the transfer and terminating the\nguardianship or conservatorship upon its receipt of:\n(a) A provisional order accepting the proceeding from the court to which the\nproceeding is to be transferred which is issued under provisions similar to\nKRS 387.842; and\n(b) The documents required to terminate a guardianship or conservatorship in this\nstate.","path":["KRS Chapter 387"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=39717","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:21Z","sha256":"44db2674f2d88a55c46a6986bc03d46197d8a4ea067caadebf1ea9dc54114952","source_id":"us-ky","stale":false,"prev":"us-ky/krs-387.838","next":"us-ky/krs-387.842"},"notice":"GroundRules: Original legal text.
