{"data":{"id":"us-ky/krs-387.842","jurisdiction":"us-ky","citation":"KRS 387.842","heading":"Accepting guardianship or conservatorship transferred from another","body":"state.\n(1) To confirm transfer of a guardianship or conservatorship transferred to this state\nunder provisions similar to KRS 387.840, the guardian or conservator shall petition\nthe court in this state to accept the guardianship or conservatorship. The petition\nshall include a certified copy of the other state's provisional order of transfer.\n(2) Notice of a petition under subsection (1) of this section shall be given to those\npersons that would be entitled to notice if the petition were a petition for the\nappointment of a guardian or issuance of a protective order in both the transferring\nstate and this state. The notice shall be given in the same manner as notice is\nrequired to be given in this state.\n(3) On the court's own motion or on request of the guardian or  conservator, the\nincapacitated or protected person, or other person required to be notified of the\nproceeding, the court shall hold a hearing on a petition filed pursuant to subsection\n(1) of this section.\n(4) The court shall issue an order provisionally granting a petition filed under\nsubsection (1) of this section unless:\n(a) An objection is made and the objector establishes that transfer of the\nproceeding would be contrary to the interests of the incapacitated or protected\nperson; or\n(b) The guardian or conservator is ineligible for appointment in this state.\n(5) The court shall issue a final order accepting the proceeding and appointing the\nguardian or conservator as guardian or conservator in this state upon its receipt from\nthe court from which the pr oceeding is being transferred of a final order issued\nunder provisions similar to KRS 387.840 transferring the proceeding to this state.\n(6) Not later than ninety (90) days after issuance of a final order accepting transfer of a\nguardianship or conservatorship, the court shall determine whether the guardianship\nor conservatorship needs to be modified to conform to the law of this state.\n(7) In granting a petition under this section, the court shall recognize a guardianship or\nconservatorship order from the other state, including the determination of the\nincapacitated or protected person's incapacity and the appointment of the guardian\nor conservator.\n(8) The denial by a court of this state of a petition to accept a guardianship or\nconservatorship transferred  from another state does not affect the ability of the\nguardian or conservator to seek appointment as guardian or conservator in this state\nunder this chapter if the court has jurisdiction to make an appointment other than by\nreason of the provisional order of transfer.","path":["KRS Chapter 387"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=39718","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:21Z","sha256":"fa8513062f073274e96618b06e29037a0d0e815fcc64c86e14c75be0e7becf02","source_id":"us-ky","stale":false,"prev":"us-ky/krs-387.840","next":"us-ky/krs-387.844"},"notice":"GroundRules: Original legal text.
