{"data":{"id":"us-ky/krs-387.885","jurisdiction":"us-ky","citation":"KRS 387.885","heading":"Court order establishing trust -- Other matters to be addressed in court","body":"order.\nUpon review of the petition and the supplemental information and report, if it appears to\nthe court that the circumstances indicate that the special needs person qualifi es as a\nbeneficiary for whom a special needs trust may properly be established under 42 U.S.C.\nsec. 1396p, the court may order that the trust be established. The court may then proceed\nto determine whether as part of the order there are other matters to be  addressed,\nincluding but not limited to the following:\n(1) Whether the proposed trustee or each co-trustee is suitable;\n(2) Whether all or a portion of the assets or income, or both, belonging to or payable to\nthe special needs person should become part of the trust;\n(3) Whether there are any charges against the funds which should be paid before the\ntrust be established;\n(4) The suitability of requiring surety on the bond of the trustee or co-trustees; and\n(5) Any other matters the court deems appropriate for ruling.\nThe order of the court establishing the trust shall be final and appealable on the same\nbasis as any other civil proceeding involving trusts.","path":["KRS Chapter 387"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=40239","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:21Z","sha256":"a95c390664c2fd2bce599d1c6341afbbedf60f3227b9313d0725b74ca9dd4dc4","source_id":"us-ky","stale":false,"prev":"us-ky/krs-387.880","next":"us-ky/krs-387.890"},"notice":"GroundRules: Original legal text.
