{"data":{"id":"us-ky/krs-387.890","jurisdiction":"us-ky","citation":"KRS 387.890","heading":"Court order modifying existing trust -- Jurisdiction and venue.","body":"The court may enter an order modifying an existing trust, whether established by the court\nunder this chapter, or whether the trust has been otherwise established, upon petition\ndemonstrating to the court that there is just cause to modify the trust to pre serve the trust\npurposes of protecting the trust assets for the benefit of the special needs person. Any\nsuch petition shall comport with KRS 387.870, 387.875, and 387.880. If the trust is\nadministered or registered in a county other than where the special  needs person resides\nwhen a petition is brought to modify a trust, jurisdiction and venue shall be determined in\naccordance with KRS 386B.2 -030, except that no such order of modification shall limit,\nmodify, or defeat the trustee's duty, where required un der 42 U.S.C., sec. 1396p, to\nreimburse the state from the trust assets for benefits paid on behalf of the special needs\nperson at the death of the special needs person, or the termination of the trust during the\nlifetime of the special needs person, as the case may be.","path":["KRS Chapter 387"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=43173","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:21Z","sha256":"ddb0a5296e8258161dcef5bf7119f9a3d590678863c9c4afa6cd6adae68af61b","source_id":"us-ky","stale":false,"prev":"us-ky/krs-387.885","next":"us-ky/krs-387.895"},"notice":"GroundRules: Original legal text.
