{"data":{"id":"us-ky/krs-390.380","jurisdiction":"us-ky","citation":"KRS 390.380","heading":"Application to existing relationships.","body":"(1) Except as otherwise provided in this chapter, on and after July 15, 2020:\n(a) This chapter applies to a power of appointment created before, on, or after\nJuly 15, 2020;\n(b) This chapter applies to a judicial proceeding concerning a power of\nappointment commenced on or after July 15, 2020;\n(c) This chapter applies to a judicial proceeding concerning a power of\nappointment commenced before July 15, 2020, unless the court finds that\napplication of a particular provision of this chapter would substantially\ninterfere with the effective conduct of the judicial proceeding or prejudice a\nright of a party, in which case the particular provision of this chapter does not\napply and the superseded law applies;\n(d) A rule of construction or presumption provided in this ch apter applies to an\ninstrument executed before July 15, 2020, unless there is a clear indication of\na contrary intent in the terms of the instrument; and\n(e) An act done before July 15, 2020, is not affected by this chapter.\n(2) If a right is acquired, ext inguished, or barred on the expiration of a prescribed\nperiod that commenced under law of the Commonwealth other than this chapter,\nbefore July 15, 2020, the law continues to apply to the right.","path":["KRS Chapter 390"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=50145","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:23Z","sha256":"d627a066a53f2d0aa5983edac6baa110752d0629db8b2ea9ace97d12c983c3e1","source_id":"us-ky","stale":false,"prev":"us-ky/krs-390.370","next":"us-ky/krs-391.010"},"notice":"GroundRules: Original legal text.
