{"data":{"id":"us-ky/krs-391.105","jurisdiction":"us-ky","citation":"KRS 391.105","heading":"Determination of rights of intestate succession in the case of a person born","body":"out of wedlock.\n(1) For the purpose of intestate succession, if a relationship of parent and child must be\nestablished to determine succession by, through, or from a person, a person born out\nof wedlock is a child of the natural mother. That person is also a child of the natural\nfather if:\n(a) The natural parents participated in a marriage ceremony before or after the\nbirth of the child, even though the attempted marriage is void; or\n(b) In determining the right of the child or its descendants to inherit from or\nthrough the father:\n1. There has been an adjudication of paternity before the death of the\nfather; or\n2. There has been an adjudication of paternity after the death of the father\nbased upon clear and convincing proof;\n(c) In determining the right of the father or his kindred to inherit from or through\nthe child:\n1. There has been an adjudication of paternity before the death of the child;\nor\n2. There has been an adjudica tion of paternity after the death of the child\nbased on clear and convincing proof and the evidence in such\nadjudication shall have demonstrated that the father openly treated the\nchild as his, and the father did not follow a consistent policy of refusing\nto support the child on the ground of nonpaternity.\n(2) The terms and conditions set out in this section shall also apply in actions brought\npursuant to KRS 411.130 and 411.135.","path":["KRS Chapter 391"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=36142","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:23Z","sha256":"9f0b3ea7e80c3bf2d3ed79dd9794afa9f1f22898fa7007b19eb13d2e2ebf4ecf","source_id":"us-ky","stale":false,"prev":"us-ky/krs-391.100","next":"us-ky/krs-391.110"},"notice":"GroundRules: Original legal text.
