{"data":{"id":"us-ky/krs-391.160","jurisdiction":"us-ky","citation":"KRS 391.160","heading":"Authority of life tenant to invade corpus.","body":"(1) If\n(a) A devise, bequest, or conveyance of real or personal property is made by\nwritten instrument free of any trust; and\n(b) By the express terms of the instrument or by rule of law the devise, bequest or\nconveyance is made to a life tenant with power to consume principal or invade\ncorpus, with the remainder to another upon the death of the life tenant; and\n(c) The instrument does not expressly state the purpose for or the extent to which\nthe life tenant may consume principal or invade corpus, then the provisio ns of\nsubsection (2) shall apply.\n(2) The life tenant's power to consume principal or invade corpus shall be limited to\nsuch consumption or invasion as shall be necessary for his health, education\n(including college and professional education), and suppor t in his accustomed\nmanner of living.\n(3) If\n(a) A devise, bequest, or conveyance of real or personal property is made in trust\nby written instrument; and\n(b) By the express terms of the trust instrument or by rule of law the devise,\nbequest or conveyance is made for the benefit of a tenant for life with power\nin the trustee to consume principal or invade corpus for the benefit of the life\ntenant, with remainder to another upon the death of the life tenant; and\n(c) The instrument does not expressly stat e the purpose for or the extent to which\nthe trustee may consume principal or invade corpus for the benefit of the life\ntenant, then the provisions of subsection (4) shall apply.\n(4) The trustee's power to consume principal or invade corpus for the benefi t of the life\ntenant shall be limited to such consumption or invasion as shall be necessary for his\nhealth, education (including college and professional education), and support in his\naccustomed manner of living.","path":["KRS Chapter 391"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=36148","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:23Z","sha256":"3c5321fedd8c7c045fed38668f29c236ee2f508592a4dd582f5bef306a5360d6","source_id":"us-ky","stale":false,"prev":"us-ky/krs-391.150","next":"us-ky/krs-391.170"},"notice":"GroundRules: Original legal text.
