{"data":{"id":"us-ky/krs-391.360","jurisdiction":"us-ky","citation":"KRS 391.360","heading":"Written provisions for nonprobate transfer on death.","body":"(1) A written provision for a nonprobate transfer on death in an insurance policy,\ncontract of employment, bond, mortgage, promissory note, certified or uncertified\nsecurity account agreement, custodial agreement, deposit agreement, compensation\nplan, pension plan, individual retirement plan, employee benefit plan, trust,\nconveyance, deed of gift, marital property agreement, or other written instrument of\na similar nature is nontestamentary. These written provisions shall include, but not\nbe limited to, written provisions which provide that:\n(a) Money or other benefits due to, controlled, or owned by a decedent before\ndeath shall be paid after the decedent's death to a person whom the decedent\ndesignates either in the instrument or in a separate writing, includi ng a will,\nexecuted before, at the same time, or after the instrument is executed;\n(b) Money due or to become due under the instrument shall cease to be payable in\nthe event of the death of the promisee or the promissor before payment or\ndemand; or\n(c) Any property, controlled by or owned by the decedent before death, which is\nthe subject of the instrument shall pass to a person the decedent designates\neither in the instrument or in a separate writing, including a will, executed\nbefore, at the same time, or after the instrument is executed.\n(2) This section shall not limit the rights of creditors under other laws of this state.","path":["KRS Chapter 391"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=36173","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:23Z","sha256":"d847e3d927fcd979d8f9ef8408de1f6fc6df6f06c779fb5226ba1877eba0f428","source_id":"us-ky","stale":false,"prev":"us-ky/krs-391.355","next":"us-ky/krs-392.010"},"notice":"GroundRules: Original legal text.
