{"data":{"id":"us-ky/krs-392.130","jurisdiction":"us-ky","citation":"KRS 392.130","heading":"Release of dower or curtesy upon sale of estate of infant or mentally","body":"disabled spouse.\nThe spouse of an infant spouse, or of a spouse judicially declared mentally disabled, if the\nspouse not under disability is of the age of eighteen (18) years, or if not, with the approval\nof the Circuit Court, on such terms as it may deem equitable, may unite with his guardian\nor conservator, or with the commissioner of the court, in the conveyance of the real estate\nof the spouse under disability, so as to release t he inchoate right of dower or curtesy of\nthe spouse not under disability, when a sale and conveyance of the real estate are ordered\nto be made by the guardian or conservator, or by the commissioner or other officer of the\ncourt. An infant spouse may also b e permitted by the Circuit Court to unite with his adult\nspouse in the conveyance of the adult spouse's real estate without terms, or on such terms\nas may be deemed equitable, so as to release the inchoate right of dower or curtesy of the\ninfant spouse. If, in judicial proceedings to sell the real estate of an infant spouse, or of a\nspouse judicially declared mentally disabled, his spouse is made a party defendant, and by\nanswer, and on privy examination in open court or by a judge of a court in which such\nproceedings are pending, or by a commissioner appointed by the court to take the case,\nthe spouse not under disability consents to a sale of the property, free from the inchoate\nright of dower or curtesy of the spouse not under disability, either without t erms or on\nterms designated by the spouse not under disability, the court may, if it deems the terms\nof such consent equitable, order the sale of such property, free from the inchoate right of\ndower or curtesy, upon the terms of consent proposed by that spouse.","path":["KRS Chapter 392"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=36186","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:23Z","sha256":"efdeb47df28bf6a2906ddf0abc6841c2c5020af8742a6450f426ef4cc43f3254","source_id":"us-ky","stale":false,"prev":"us-ky/krs-392.120","next":"us-ky/krs-392.140"},"notice":"GroundRules: Original legal text.
