{"data":{"id":"us-ky/krs-393.063","jurisdiction":"us-ky","citation":"KRS 393.063","heading":"Treatment of refunds of workers' compensation special fund assessments","body":"held by an insurance carrier and owed to an insured employer.\n(1) Notwithstanding any provision of the Kentucky Revised Statutes to the contrary,\nrefunds of workers' compensation s pecial fund assessments levied in accordance\nwith KRS 342.122 shall be deemed \"unclaimed refunds\" if held by an insurance\ncarrier and owed to an insured employer.\n(2) For purposes of this section, \"unclaimed refunds\" means all unremitted workers'\ncompensation special fund assessments collected by a carrier, as defined in KRS\n342.0011(6), in excess of the applicable special fund assessment rate, owing and\nunpaid to an insured employer after the Kentucky Workers' Compensation Funding\nCommission has made a det ermination that the carrier has made a reasonable\nattempt to return the unclaimed refunds to the insured employer.\n(3) Unclaimed refunds shall be remitted by the insurance carrier to the Kentucky\nWorkers' Compensation Funding Commission, created under KRS 342.1223, and\nshall be credited to the benefit reserve fund, created under KRS 342.1229, within\nthe Kentucky Workers' Compensation Funding Commission. Unclaimed refunds\nremitted to the Kentucky Workers' Compensation Funding Commission and held by\nthat comm ission for more than two (2) years shall become the property of the\nbenefit reserve fund.\n(4) The unclaimed refunds remitted as required in this section to the Kentucky Workers'\nCompensation Funding Commission and held for more than two (2) years shall not\nthereafter be available to any party who may have a claim to the remitted unclaimed\nrefunds, and any claims that arise under this section including claims for the\nremitted sums shall be forever barred against the Kentucky Workers' Compensation\nFunding Commission and any carrier complying with this section.\n(5) The provisions of this section shall apply to any refunds or unclaimed refunds\nowing and held by a carrier on or after July 15, 1998.","path":["KRS Chapter 393"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=36197","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:23Z","sha256":"e159df4aef0b495fc72a1df4c1279374a68de97f458284b4044efa550339fc5e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-393.062","next":"us-ky/krs-393.064"},"notice":"GroundRules: Original legal text.
