{"data":{"id":"us-ky/krs-393a.100","jurisdiction":"us-ky","citation":"KRS 393A.100","heading":"When security presumed abandoned.","body":"(1) Subject to KRS 393A.120, a security shall be presumed abandoned three (3) years\nafter:\n(a) The date a second consecutive communication sent by the holder by first-class\nUnited States mail to the apparent owner is returned to the holder undelivered\nby the United States Postal Service; or\n(b) If the second communication is made later than thirty (30) days after the first\ncommunication is returned, the date the first communication is returned\nundelivered to the holder by the United States Postal Service.\n(2) If the holder does not send communications to the apparent owner of a security by\nfirst-class United States mail, the holder shall attempt to confirm the apparent\nowner's interest in the security by sending the apparent owner an electronic -mail\ncommunication not later than two (2) years after the apparent owner's last indication\nof interest in the security. However, the holder promptly shall attempt to contact the\napparent owner by first-class United States mail if:\n(a) The holder does not have information n eeded to send the apparent owner an\nelectronic-mail communication or the holder believes that the apparent\nowner's electronic-mail address in the holder's records is not valid;\n(b) The holder receives notification that the electronic -mail communication was\nnot received; or\n(c) The apparent owner does not respond to the electronic -mail communication\nwithin thirty (30) days after the communication was sent.\n(3) If first-class United States mail sent under subsection (2) of this section is returned\nto the hol der undelivered by the United States Postal Service, the security shall be\npresumed abandoned three (3) years after the date the mail is returned.","path":["KRS Chapter 393A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=48107","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:24Z","sha256":"00357bff287a3755fcd9f4b7cfb07b869006e358e3c4739114b2f7c4781949b1","source_id":"us-ky","stale":false,"prev":"us-ky/krs-393a.090","next":"us-ky/krs-393a.110"},"notice":"GroundRules: Original legal text.
