{"data":{"id":"us-ky/krs-393a.130","jurisdiction":"us-ky","citation":"KRS 393A.130","heading":"Knowledge of death of insured or annuitant.","body":"(1) As used in this section, \"death master file\" means the United States Social Security\nAdministration Death Master File or other database or service that is at least as\ncomprehensive as the United States Social Security Administration Death Master\nFile for determining that an individual reportedly has died.\n(2) With respect to a life or endowment insurance policy or annuity contract for which\nan amount is owed on proof of death, but which has not matured by proof of death\nof the insured or annuitant, the comp any has knowledge of the death of an insured\nor annuitant when:\n(a) The company receives a death certificate or court order determining that the\ninsured or annuitant has died;\n(b) The company conducts a comparison for any purpose between a death master\nfile and the names of some or all of the company's insureds or annuitants,\nfinds a match that provides notice that the insured or annuitant has died, and\nvalidates the death;\n(c) The administrator or the administrator's agent conducts a comparison for the\npurpose of finding matches during an examination conducted under KRS\n393A.550 to 393A.650 between a death master file and the names of some or\nall of the company's insureds or annuitants, finds a match that provides notice\nthat the insured or annuitant has died, and the company validates the death; or\n(d) The company:\n1. Receives notice of the death of the insured or annuitant from an\nadministrator, beneficiary, policy owner, relative of the insured, or\ntrustee or from a personal representative, executor, or other legal\nrepresentative of the insured's or annuitant's estate; and\n2. Validates the death of the insured or annuitant.\n(3) The following rules apply under this section:\n(a) A death-master-file match under subsection (2)(b) or (c) of this section occurs\nif the criteria for an exact or partial match are satisfied as provided by KRS\n304.15-420;\n(b) The death-master-file match shall not constitute proof of death for the purpose\nof submission to an insurance company of a claim by a beneficiary, annuitant,\nor owner of the policy or contract for an amount due under an insurance policy\nor annuity contract; and\n(c) The death-master-file match or validation of the insured's or annuitant's death\nshall not alter the requirements for a beneficiary, annuitant, or owne r of the\npolicy or contract to make a claim to receive proceeds under the terms of the\npolicy or contract.","path":["KRS Chapter 393A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=48110","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:24Z","sha256":"6c93ce18bde593c58e05aefce1965dae4fd58e83626ea1875a1b4000c463d632","source_id":"us-ky","stale":false,"prev":"us-ky/krs-393a.120","next":"us-ky/krs-393a.140"},"notice":"GroundRules: Original legal text.
