{"data":{"id":"us-ky/krs-393a.500","jurisdiction":"us-ky","citation":"KRS 393A.500","heading":"When property subject to recovery by another state.","body":"(1) Property held under this chapter by the administrator shall be subject to the right of\nanother state to take custody of the property if:\n(a) The property was paid or delivered to the administrator because the records of\nthe holder did not reflect a last -known address in the other state of the\napparent owner and:\n1. The other state establishes that the last -known address of the apparent\nowner or other person entitled to the property was in the other state; or\n2. Under the law of the other state, the propert y has become subject to a\nclaim by the other state of abandonment;\n(b) The records of the holder did not accurately identify the owner of the property,\nthe last-known address of the owner was in another state, and, under the law\nof the other state, the property has become subject to a claim by the other state\nof abandonment;\n(c) The property was subject to the custody of the administrator of this state under\nKRS 393A.190 and, under the law of the state of domicile of the holder, the\nproperty has become subj ect to a claim of abandonment by the state of\ndomicile of the holder; or\n(d) The property:\n1. Is a sum payable on a traveler's check, money order, or similar\ninstrument that was purchased in the other state and delivered to the\nadministrator under KRS 393A.200; and\n2. Under the law of the other state, has become subject to a claim by the\nother state of abandonment.\n(2) A claim by another state to recover property under this section shall be presented in\na form prescribed by the administrator, unless the administrator waives presentation\nof the form.\n(3) The administrator shall decide a claim under this section not later than ninety (90)\ndays after it is presented. If the administrator determines that the other state is\nentitled under subsection (1) of this section to custody of the property, the\nadministrator shall allow the claim and pay or deliver the property to the other state.\n(4) The administrator may require another state, before recovering property under this\nsection, to agree to indemnify this state  and its agents, officers, and employees\nagainst any liability on a claim to the property.","path":["KRS Chapter 393A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=48147","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:25Z","sha256":"beab1c8f54e7361bc1d11be365c21110c167858d0182a3970facca5d206987af","source_id":"us-ky","stale":false,"prev":"us-ky/krs-393a.490","next":"us-ky/krs-393a.510"},"notice":"GroundRules: Original legal text.
